Terms & Conditions

These Terms & Conditions apply to all quotations, contracts and works undertaken by ARC Fencing and Paving (“The Contractor”).

By accepting a quotation, paying the required deposit or instructing ARC Fencing and Paving to commence work, The Client agrees to be bound by these Terms & Conditions.

These Terms & Conditions are governed by the laws of England and Wales.

• All quotations are valid for 30 days from the date issued unless otherwise stated.
• Quotations are based upon site conditions visible at the time of inspection.
• Should unforeseen circumstances arise after work commences, including hidden obstructions, underground services, poor ground conditions or changes requested by the Client, additional costs may apply.
• Prices may be amended if there are significant increases in the cost of materials, fuel or supplier charges before work begins.
• Planning permission, Building Regulations approval and any statutory permissions remain the responsibility of the Client unless otherwise agreed in writing.

Acceptance of a quotation, payment of the deposit, or instruction to commence works shall constitute acceptance of these Terms & Conditions in full.

No verbal amendments shall form part of the contract unless confirmed in writing.

The following payment schedule applies:

• 30% non-refundable deposit payable seven (7) days before the agreed commencement date.
• 70% balance payable immediately upon completion of the works.

The deposit secures labour, materials and your agreed start date. Failure to pay the deposit by the due date may result in your project being postponed or cancelled.

For larger projects, or where substantial material costs or specialist subcontractors are involved, ARC Fencing and Paving reserves the right to request a larger advance payment by mutual agreement.

Late payments may incur interest at 5% above the Bank of England base rate, together with any reasonable legal and debt recovery costs.

The Client agrees to:

• Provide safe and unrestricted access during working hours.
• Provide access to water and electricity where reasonably available.
• Remove vehicles, garden furniture, ornaments and personal belongings from the working area.
• Keep children, pets and visitors away from active work areas.
• Inform the Contractor of any known underground pipes, cables, drainage systems or boundary issues.
• Ensure neighbouring access issues are disclosed before work commences.
• Obtain any permissions required before works begin.

Only the work described within the accepted quotation is included within the agreed price.

Additional work requested after acceptance shall be treated as a variation and may incur additional costs.

Any variations must be agreed before work proceeds.

Quotations are based on visible site conditions only. Should excavation reveal hidden issues including:

• Tree roots
• Concrete foundations
• Buried rubble
• Existing paving
• Drainage systems
• Water mains
• Gas pipes
• Electric cables
• Poor sub-base
• Contaminated ground

additional labour, machinery and materials required will be chargeable.

Timber is a natural product. Natural movement including:

• Shrinkage
• Expansion
• Twisting
• Splitting
• Surface cracking
• Knots
• Resin bleed

is normal and shall not be considered a defect.

The Contractor cannot guarantee fencing against damage caused by storms, flooding, high winds, impact damage or ground movement.

Natural stone, porcelain, concrete products and block paving vary naturally in colour, shade, texture, pattern and finish. These variations are not defects.

Newly laid paving requires curing time.

Clients must not drive on new driveways until advised that they are suitable for use. Minor settlement may occur naturally and does not necessarily indicate faulty workmanship.

Where drainage work is included, the Contractor shall install systems in accordance with the agreed specification.

ARC Fencing and Paving accepts no responsibility for defects within existing drainage systems not installed by the Contractor.

Materials delivered to site become the Client’s responsibility.

Surplus materials remain the property of ARC Fencing and Paving unless otherwise agreed.

Ownership of all supplied materials shall remain with ARC Fencing and Paving until full payment has been received.

Completion dates are estimates only. ARC Fencing and Paving shall not be liable for delays caused by:

• Adverse weather
• Supplier shortages
• Utility companies
• Staff illness
• Vehicle breakdown
• Hidden ground conditions
• Events beyond reasonable control

The Client may cancel the Contract by providing written notice.

The 30% deposit is non-refundable and secures the agreed start date, labour allocation and ordering of materials.

If cancellation occurs within seven (7) days of the agreed commencement date, the deposit will be retained.

Where materials have been ordered, skips hired, plant or machinery booked, or subcontractors engaged, any unrecoverable costs shall remain payable.

Where work has already commenced, payment shall be due for all completed work, materials supplied and costs reasonably incurred.

ARC Fencing and Paving maintains Public Liability Insurance. Any accidental damage caused through proven negligence shall be dealt with promptly and, where appropriate, through our insurers.

We provide a 12-month workmanship guarantee on all completed installations. This guarantee covers defects arising directly from our workmanship. The guarantee does not cover:

• Ground movement
• Storm damage
• Flooding
• Lack of maintenance
• Vehicle damage
• Third-party damage
• Natural timber movement
• Natural colour variation
• Manufacturer defects
• Fair wear and tear

ARC Fencing and Paving reserves the right to photograph completed works for use on its website, social media and marketing material. No personal information or identifiable images of clients will be published without permission.

Should you be dissatisfied with any aspect of our work, please notify us in writing as soon as reasonably possible. We are committed to resolving genuine concerns fairly and promptly.

These Terms & Conditions are governed by the laws of England and Wales. Both parties agree to attempt to resolve any dispute through discussion before commencing legal proceedings.
